MODIFIED AGREEMENT.
IN NO EVENT WILL JACKSPEED BE LIABLE FOR (I) ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMMES OR INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, OR ANY INFORMATION, OR TRANSACTIONS PROVIDED ON THE SERVICE, OR DOWNLOADED FROM THE SERVICE, OR ANY DELAY OF SUCH INFORMATION OR SERVICE, EVEN IF JACKSPEED OR ITS AUTHORISED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SERVICE AND/OR MATERIALS OR INFORMATION DOWNLOADED THROUGH THE SERVICE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. All quotations and prices are given without obligation. The publication of a new price list invalidates all previous prices.
Each buyer will be given a login ID and password. This information is provided by Jackspeed and is not eligible for change by the Buyer. Any changes on such information shall require Jackspeed approval. This information shall be kept confidential. Disclosure to a third party is not allowed.
All orders for Goods shall be deemed to be an offer by the Buyer to
purchase Goods pursuant to these Terms and Conditions and are
subject to acceptance by Jackspeed. Jackspeed may choose not to
accept an order for any reason. Proper order details have to be input
into this online ordering system. Jackspeed shall not be held
responsible for any mistake or inaccuracy in information provided by
Buyers. Once the Buyer has placed an order through the Online
Ordering System, an Order Confirmation will be sent to the Buyer with
an expected date of dispatch for the Order. Any amendment or
cancellation raised after the order confirmation is made shall be
charged, depending on the stage of the order. Special Offers and items
of limited availability can be withdrawn without notice.
The Buyer is hereby notified that Jackspeed does file details of the
Buyer’s order.
At this initial stage, payment must be arranged on T/T in advance or
L/C at sight. Production will only commence when the monies are
credited into our bank account. After an observation period, Buyer may
be granted a credit line with limited terms. In this instance, payment
of the total purchase price (including delivery charges) must be made
in full before the dispatch of the Goods. Jackspeed shall endeavour
within reason to meet any date stated for delivery. In any event the
estimated delivery time is not met, Jackspeed shall not be liable for
any loss, cost, damage or expenses incurred by the Buyer or any third
party arising directly or indirectly from failure to meet any estimated
delivery date.
The price the Buyer pays is the price stated in an email reply from
Jackspeed, in response to the Buyer’s online enquiry, and/or the price
stated in Jackspeed’s Quotation (where applicable). If Jackspeed discovers an error in its Quotation or in the price of goods the Buyer
has ordered, Jackspeed will inform the Buyer as soon as possible.
Existing pattern goods can be delivered in 2-3 working days after
payment has been received / order has been confirmed, whereas
custom/new pattern goods can be delivered 5-7 days after payment
has been received / order has been confirmed. Product prices are
quoted on an ex-factory basis, therefore Buyer has the option to
arrange for a courier service based on his own preference. If Buyer
finds Jackspeed’s freight cost to be more favourable or competitive,
Jackspeed canl assist to arrange delivery on Buyer’s behalf. Where
stated, weights are approximate, and include immediate packaging.
They are given so that an estimate of postage costs can be calculated.
The actual and final postage charge will take into account the size of
the packaging and materials used.
Acceptance of delivery of the Goods shall be deemed conclusive
evidence of the Buyer’s acceptance of these Terms and Conditions.
Delivery of the Goods shall be made to the location and on such terms
as agreed between Jackspeed and the Buyer at the time the order is
placed. Title and risk for the Goods shall pass to the Buyer upon
delivery of the Goods. If the Buyer has provided Jackspeed with the
wrong delivery address and the goods are signed for by another party,
Jackspeed cannot be held responsible for any loss the Buyer incurs as
a result.
